Clients Charter

1. To ensure that client's waiting time to be attended to at the counter does not exceed fifteen (15) minutes.
   
2. To ensure that mediation services are concluded within thirty (30) days from the date of both parties' consent for mediation.

To ensure that pleadings are completed within - 

(a) For non-mediation cases, thirty (30) days from the date of receipt of complete documentation.

(b) For mediation cases, twenty-one (21) days from the date of the conclusion of the mediation sessions.

   
4. To ensure that cases are filed in courts within fourteen (14) days after the completions of pleadings.
   
5. To ensure that the fair order/judgment is served on client within seven (7) days upon receipt of the same from court.
   
   

Procedure For Legal Aid

Procedure for Legal Aid

  • Applicant to register
  • Applicant to fill up the means test and statutory declaration forms
  • Means test conducted
  • Interview conducted to identify issues, remedies and needs of applicant
  • Application processed (not more than 3 days)
  • If the application is approved, legal aid terms will be offered
  • Applicant to pay a registration fee of RM10.00 and a contribution (if applicable) if he accepts the terms
  • Legal aid granted
  • Brief opened and registered
  • Brief filed into court

Discharge and Revocation of Certificate

Cancellation of Certificate

Under section 19 of the Legal Aid Act 1971 the Director General of Legal Aid or any person appointed under subsection 3(2) may cancel a legal aid certificate. According to regulation 7 of the Legal Aid Regulations 2017, a legal aid certificate may be revoked in any of the following circumstances:

  • at the request of the person to whom it is issued;
  • the applicant has been required to make a contribution and any payment in respect thereof is more than 30 days in arrears;
  • if the Director General is satisfied that the proceedings have been disposed of;
  • where the Director General is satisfied that the aided person has required the proceeding to be conducted unreasonably so as to incur an unjustifiable expense to the Department;
  • if the aided person has died;
  • if the aided person has had a receiving a bankruptcy;
  • if the income of the aided person exceeds RM50,000.00 per annum upon further determination;
  • if as a result of any information the Director General considers the aided person no longer has reasonable grounds of being a party to the proceedings and it is unreasonable for him to continue to receive legal aid;
  • if the aided person in furnishing information has knowingly made a false statement or false representation.

Eligibility of The Applicant

Category I

The yearly financial resources amounting to RM50,000 and below;

Category II

Annual financial resources exceed RM50,000 but not exceeding RM70,001,

Category III

Exceed RM70,001 per annum (with Minister's approval)
