
The Legal Aid Department (LAD) is a Government department that provides legal aid services to eligible person in accordance with the Legal Aid Act 1971. Government aims to provide legal services to the public at a lower fee as an alternative to services offered by private lawyers.
LAD’s jurisdiction extends to matters as follows:-
1) Legal advice in all legal matters
2) Legal aid in proceeding matters (litigation) as follows:-
i) Criminal matters
ii) Various type of civil matters
iii) Civil family matters
iv) Syariah family matters
3) Mediation for Syariah and Civil cases
4) Legal companion services
- LAD provides mediation service for all Malaysian citizen. Mediation is a process where parties to a dispute may resolve their dispute voluntarily and peacefully with the assistance of a third party known as the mediator.
- Mediation service is provided to the aided person in disputes which is related to any proceedings as stated in the Third Schedule of the Legal Aid Act 1971.
- If both parties to a dispute consented for mediation, the dispute will be settled within 30 days through mediation session attended by both parties.
- Parties are encouraged to use mediation service to settle their dispute amicably without going through complicated trial process in court considering that the mediation method is time saving and is targeted to achieve a win-win situation.
Types of cases which are suitable for mediation are:-
Civil mediation
- Maintenance of wife and children
- Matrimonial assets
- Welfare of children
- Terms for dissolution of marriage under joint petition
- Motor vehicle accidents not involving insurance company
- Consumer claim
- Small estate
Syariah mediation
- Maintenance of wife
- Iddah maintenance
- Maintenance of children
- Arrears of maintenance
- Variation of maintenance order
- Child custody
- Mutaah
- Grant (Hibah)
- Will (Wasiat)
- Marital debt
- Betrothal damages
- Matrimonial property
Criminal, Civil and Syariah Proceedings
LAD also provides legal aid services with regard to any court proceeding to an eligible person under the Legal Aid Act 1971.
The schedule below shows the eligibility limit of aided person in criminal, civil and syariah proceedings, the fees and its related contribution:-

i) Criminal Proceedings
Legal aid in criminal cases is as stated in the Second Schedule of the Act that includes:
- All criminal proceedings in which the accused not being represented by counsel pleads guilty to the charge or charges and wishes to make a plea in mitigation in respect thereof.
- Criminal proceedings under the Child Act 2001 [Act 611]; and
- Criminal proceedings under the Minor Offences Act 1955 [Act 336]
ii) Civil Proceedings
Legal aid in civil action is as stated in the Third Schedule of the Legal Aid Act 1971 which covers both family matters and civil actions.
Civil cases include proceedings in relation to:
- Proceedings under the Married Women and Children (Maintenance) Act 1950 [Act 263]
- Proceedings under the Maintenance Ordinance 1959 (Sabah No.7 of 1959)
- Proceedings under the Sarawak Customary Marriages (Maintenance) Ordinance 2003 (Cap. 55)
- Proceedings under the Maintenance Orders (Facilities for Enforcement) Act 1949 [Act 34] for a provisional order
- Proceedings under the Married Women and Children (Enforcement of Maintenance) Act 1968 [Act 356]
- Rights and liabilities in respect of proceedings for divorce and custody
- Rights and liabilities under the Adoption Act 1952 [Act 257]
- Rights and liabilities under the Adoption Ordinance 1960 (Sabah No. 23 of 1960)
- Proceedings under the Sarawak Adoption Ordinance (Cap. 91)
- Rights and liabilities under the Small Estates (Distribution) Act 1955 [Act 98]
- Applications for Probate and Letters of Administration
- Rights and liabilities under the Probate and Administration Ordinance 1947 Sabah (Cap. 109)
- Rights and liabilities under the Sarawak Administration of Estate Ordinance (Cap. 80)
- Rights and liabilities under the Padi Cultivators (Control of Rent and Security of Tenure) Act 1967 [Act 528]
- Rights and liabilities in respect of civil action for damages arising from accidents involving motor vehicles within the meaning of the Road Transport Act 1987 [Act 333]
- Rights and liabilities under the Moneylenders Act 1951 [Act 400]
- Rights and liabilities in respect of proceedings relating to tenancy
- Rights and liabilities under the Hire-Purchase Act 1967 [Act 212]
- Consumer claims
iii) Syariah Proceedings
Syariah cases include proceedings in relation to:
- Proceedings relating to betrothal (damages), maintenance, custody, divorce, marital debt, mutaah and harta sepencarian
- Proceedings relating to gifts inter vivos (hibah) and will.

Bahagian Pengantaraan (Syariah)
1. Menyediakan khidmat pengantaraan melalui proses-proses berikut:
a) | Mengadakan fungsi pengantaraan dalam tempoh (30) tiga puluh hari dari tarikh perjanjian persetujuan untuk pengantaraan ditandatangani | |
b) | Menyaksikan pihak-pihak menandatangani perjanjian persetujuan untuk pengantaraan | |
c) | Menjalankan pengantaraan setelah sesuatu kes didaftarkan | |
d) | Menyediakan perjanjian penyelesaian selepas penyelesaian dicapai oleh pihak-pihak dalam sesi pengantaraan | |
e) | Menyaksikan pihak-pihak menandatangani perjanjian penyelesaian | |
f) | Menyerahkan fail kes yang telah melalui proses pengantaraan kepada Bahagian Litigasi dan Nasihat (Syariah) untuk merekodkan penghakiman persetujuan di mahkamah | |
g) | Mengemaskini Buku Daftar Kes Pengantaraan (Syariah) dan sistem SPK JBG bagi setiap sidang pengantaraan yang diadakan | |
h) | Menyediakan pliding berkenaan kes yang telah menandatangani perjanjian penyelesaian untuk di bawa ke mahkamah |

f) Menyerahkan fail kes yang telah melalui proses pengantaraan kepada Bahagian Litigasi dan Nasihat (Syariah) untuk merekodkan penghakiman persetujuan di mahkamah
g) Mengemaskini Buku Daftar Kes Pengantaraan (Syariah) dan sistem SPK JBG bagi setiap sidang pengantaraan yang diadakan
h) Menyediakan pliding berkenaan kes yang telah menandatangani perjanjian penyelesaian untuk di bawa ke mahkamah
2. Mengemaskini statistik dan laporan berkaitan Pengantaraan Syariah setiap bulan bagi ibu pejabat dan cawangan JBG seluruh Malaysia.
3. Memantau, menyelia dan memberikan bantuan perlu kepada cawangan JBG berhubung dengan khidmat Pengantaraan Syariah.
4. Memberi penerangan tentang fungsi dan peranan Jabatan Bantuan Guaman (JBG) kepada mesyarakat dan orang ramai berkaitan dengan undang-undang Syariah.
